Terms of Service

1. Acceptance of Terms

By accessing the Duarte Landscape Inc website ("Site") or engaging our landscaping services, you ("Client," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services. We reserve the right to update these Terms at any time. Continued use of our Site or services constitutes acceptance of any changes.

2. Services

Duarte Landscape Inc provides commercial landscape maintenance, irrigation services, landscape enhancements, and landscape installation for HOA communities, property managers, commercial facilities, and other clients across Orange County and the Los Angeles South Bay.

The specific scope of work for each project will be defined in a written estimate, proposal, or service agreement provided to you before work begins. Any changes to the agreed-upon scope must be authorized in writing by both parties.

3. Estimates and Pricing

• All estimates are provided free of charge and are valid for 30 days from the date issued, unless otherwise stated
• Estimates are based on information provided to us and a visual inspection of the property at the time of assessment
• Actual costs may vary if site conditions differ materially from what was observed or described during the estimate
• We will notify you of any significant cost changes before proceeding with additional work
• Pricing for recurring maintenance contracts will be outlined in a separate service agreement

4. Payment Terms

• Payment terms are specified in your service agreement or invoice (typically Net 30 for commercial accounts)
• We accept checks, bank transfers, and major credit cards
• For new clients or one-time projects, a deposit of up to 50% may be required before work commences
• Late payments may incur a finance charge of 1.5% per month on the outstanding balance
• We reserve the right to suspend services for accounts that are more than 60 days past due

5. Cancellation and Termination

One-time projects: You may cancel a scheduled project with at least 48 hours' written notice at no charge. Cancellations with less than 48 hours' notice may be subject to a cancellation fee covering mobilization and scheduling costs.

Recurring maintenance contracts: Either party may terminate a maintenance agreement with 30 days' written notice. You will be responsible for payment of all services performed through the termination date.

Immediate termination: We reserve the right to terminate services immediately if the work environment is unsafe, payment obligations are not met, or these Terms are violated.

6. Limitation of Liability

Duarte Landscape Inc is licensed and insured. Our liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service that gave rise to the claim.

• We are not liable for damage to underground utilities, pipes, sprinkler lines, or other subsurface infrastructure that was not disclosed to us or reasonably discoverable prior to work
• We are not responsible for plant loss due to drought, disease, pest infestation, extreme weather, or client neglect after our services are completed
• We are not liable for any indirect, incidental, consequential, or punitive damages
• Claims must be reported within 7 days of service completion for us to investigate and address

7. Warranty

Landscape installation: We provide a 90-day warranty on plant materials installed by our crew, provided the client follows our recommended watering and care instructions. This warranty covers replacement of plants that fail to establish under normal conditions.

Hardscape and irrigation: We warrant workmanship on hardscape and irrigation installations for one (1) year from the date of completion. This covers defects in our work but does not cover damage from misuse, acts of nature, or third-party modifications.

Maintenance services: Our maintenance work is performed to professional industry standards. If you are unsatisfied with a specific service visit, please contact us within 48 hours and we will make it right at no additional cost.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Orange County, California. Both parties agree to submit to the personal jurisdiction of these courts.

9. Changes to These Terms

We may revise these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date at the top of this page. Your continued use of our Site or services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
